			<content:encoded><![CDATA[<p>  &#8220;Today&#8217;s report is particularly encouraging in that it shows improvement in builder confidence across every region as well as solid gains in current sales conditions, traffic of prospective buyers and sales expectations for the next six months,&#8221; noted NAHB Chairman Rick Judson, a home builder from Charlotte, N.C. &#8220;This positive momentum could be disrupted by threats on the policy side, particularly with regard to the mortgage interest deduction and federal support for the housing finance system.&#8221; </p>
<p>  All three components of the index rose in July. Current sales conditions rose five points to 60—the highest level since early 2006. The component gauging sales expectations in the next six months gained seven points to 67, and the component gauging traffic of prospective buyers rose five points to 45—marking the strongest readings for each since late 2005.</p>
<p>  &#8220;Builders are seeing more motivated buyers coming through their doors as the inventory of existing homes for sale continues to tighten,&#8221; noted NAHB Chief Economist David Crowe. &#8220;Meanwhile, as the infrastructure that supplies home building returns, some previously skyrocketing building material costs have begun to soften.&#8221;Sales of newly built homes rose just over 2 percent from May to June. Single family housing starts were flat. But permits, considered a more reliable indicator, gained 1.3 percent month-to-month. </p>

			<content:encoded><![CDATA[<p>The housing market is on firmer ground today, as two major tax provisions survived the &#8220;fiscal cliff.&#8221;  Congress did not touch the mortgage interest deduction, and it extended tax relief for one year on mortgage debt forgiveness.</p>
<p>&#8220;An extension of the tax break is positive for home values by reducing the number of foreclosures and helping more troubled borrowers stay in their homes,&#8221; wrote Jaret Seiberg of Guggenheim Partners.  &#8220;That means less supply on the market.&#8221;</p>
<p>Under a law signed in 2007, debt relief on loan modifications, short sales, and foreclosures were no longer taxable; that break expired at the end of 2012.  The fear was that if the tax break was not extended, home owners would not agree to short sales (when the home is sold for less than the value of the mortgage) because they would then face a tax bill.  They would also not agree to principal reduction loan modifications, which have proven to be far more successful than other modifications that leave the principal balance as is.</p>
<p>Under the $25 billion mortgage servicing settlement, borrowers have received $6.3 billion in mortgage principal relief through September, according to the settlement&#8217;s monitor, Joseph A. Smith, Jr.  The average loan balance reduction, $150,000.  Banks completed 13,351 principal reduction loan modifications in November alone, according to Amherst Securities Group, a 62 percent jump from September.  </p>
<p>Short sales also surged toward the end of the year, thanks to streamlined procedures and a more aggressive stance by the big banks, again in part due to the mortgage servicing settlement.  More than 98 thousand short sales were completed in the third quarter of 2012, according to RealtyTrac.</p>

<p>&#8220;The prospect of being taxed on potentially tens or hundreds of thousands of dollars in additional income may motivate more distressed homeowners to forgo a short sale and allow the home to be foreclosed,&#8221; said RealtyTrac&#8217;s Daren Blomquist in a release. &#8220;Additionally, if the mortgage interest deduction is eliminated due to the fiscal cliff quagmire, it would give many underwater and otherwise distressed homeowners one less reason to hang on to their homes.&#8221; </p>
<p>Banks completed 13,351 principal reduction loan modifications in November alone, according to a monthly report from Amherst Securities Group.  That&#8217;s a 62 percent jump from September.  Much of it is thanks to the $25 billion mortgage servicing settlement signed by the nation&#8217;s five largest banks early this year over so-called &#8220;<strong>robo-signing</strong>&#8221; foreclosure practices.</p>
<p>Banks have already given borrowers $6.3 billion in mortgage principal relief under the settlement, according to a report from its monitor, Joseph A. Smith, released last month.  <strong>Bank of America</strong> recently ramped-up its relief, reporting 30,000 customers were approved or had completed first-lien modifications through September 30 providing $4.75 billion in principal reduction.  Borrowers received an average $150,000 slash in loan balances.</p>

<p class="textBodyBlack"><span />Buyers are coming back to the housing market in ever greater numbers, as an industry index measuring contracts to purchase existing homes surged 5.2 percent in October from September. </p>
<p class="textBodyBlack"><span />The monthly gauge of pending home sales from the National Association of Realtors was also revised higher in September and is now up 13.2 percent from October of 2011. This is a forward looking indicator for closed sales one to two months from now. </p>
<p class="textBodyBlack"><span />“We’ve had very good housing affordability conditions for quite some time, but we’re seeing more impact now from steady job creation and rising consumer confidence about home buying now that home prices have clearly turned positive,” wrote Lawrence Yun, chief economist for the NAR in a release. <em>(Read More: </em><a href="/id/49795918/"><em><strong>Could Housing Be the Antidote to the &#8216;Fiscal Cliff&#8217;?)</strong></em></a></p>
<p class="textBodyBlack"><span />Pending home sales are now at the highest level since March of 2007 and have risen, on a year-over-year basis, for 18 consecutive months. The activity, however, varies from region to region, and the Realtors say the Northeast, which saw a 0.1 percent drop in sales month-to-month- did see some impact from <b><strong><strong>Hurricane Sandy</strong></strong></b>. </p>

<p class="textBodyBlack"><span />Signed contracts also declined in the West, 1.1 percent in October month-to-month and are up just 0.9 percent from a year ago. <p class="textBodyBlack"><span />Pending home sales surged in the Midwest, up 15.6 percent month-to-month and up 20 percent from a year ago. They were also higher in the south by 5.5 percent sequentially and by 17.4 percent from a year ago. </p>

<p class="textBodyBlack"><span />After a slew of positive readings on the nation’s housing recovery, <b><strong><a href="/id/49993293/"><strong>sales of newly built homes in October </strong></a></strong></b>were a big disappointment. </p>
<p class="textBodyBlack"><span />Despite the big public builders reporting big jumps in new orders and builder confidence positively leaping to the highest level since 2006, sales just didn’t compute, and even September’s numbers were revised down. </p>
<p class="textBodyBlack"><span />“The recovery in new home sales is looking a little weaker than we were previously led to believe,” writes Paul Diggle of Capital Economics. </p>
<p class="textBodyBlack"><span />But Diggle points out the positives, specifically that the time between a completion and a new home sale has been falling dramatically, from over 14 months in late 2009 to just over 6 months today. The average historically is five months. </p>
<p class="textBodyBlack"><span />“That drop strikes us as another sign that buyer confidence is improving,” adds Diggle. </p>
<p class="textBodyBlack"><span />But is it improving as much as builder confidence? </p>
<p class="textBodyBlack"><span /></p>
<p class="textBodyBlack"><span />“This was a disappointing update,” writes Patrick Newport of HIS Global Insight. </p>
<p class="textBodyBlack"><span />“It indicates that demand for single-family homes is only slowly picking up, not accelerating, as the data previously showed. It also indicated that builders may have jumped the gun a little by accelerating the pace of construction of single-family homes. </p>

<p class="textBodyBlack"><span />A big concern for home builders now is the looming <b><strong><strong>fiscal cliff</strong></strong></b>. The housing recovery depends on the economic recovery and continued improvement in the jobs picture. There is also great concern that the mortgage interest deduction could fall victim to the cliff. That’s why housing lobbyists have upped their budgets this year to $30 million from $27 million in 2011, according to the Center for Responsive Politics. The National Association of Realtors leads by far with a record $25,982,290 spent on lobbying so far. </p>

<p class="textBodyBlack"><span />Fears of the fiscal cliff could be impacting potential buyers already. The new home sales monthly number from the U.S. Department of Commerce is based on signed contracts, not closings, so it is a clear gauge of what potential buyers are feeling right now. </p>

<p class="textBodyBlack"><span />“It is making me nervous for sure to have such uncertainty over such a traditional expectation, the mortgage deduction,” says Stephen Paul, of Mid-Atlantic Builders, a Maryland-based company. Paul says he hasn’t seen any cancellations over it yet, but it has come up in conversation plenty. </p>
<p class="textBodyBlack"><span />It is just one more uncertainty that this recovery doesn’t need. All signs are pointing to big gains in the housing market for 2013. Those expectations, however, must be tempered with a dash of perspective yet again. Peter Boockvar of Miller Tabak maps it out well: </p>
<p class="textBodyBlack"><span />“While the housing industry is recovering, new home sales have trended between 360k and 370k for the last 6 months, still 73 percent below the bubblicious peak in July &#8217;05 and not too far above the trough seen in 1982 and still below the bottom seen in the 1991 recession. On one hand, there is plenty of room for continued improvement but on the other, the healing process will take a lot of time and will likely be in fits and starts as recoveries from the aftermath of bubbles typically are.” </p>

<hr noshade="noshade" size="1" />The mortgage interest deduction, however, is now at risk, due to negotiations over the so-called “<b><strong><a href="/id/49464221/" target="_blank"><strong>fiscal cliff</strong></a></strong></b>”—the year-end deadline for large spending cuts and the expiration of tax cuts.
<p class="textBodyBlack"><span />While it is impossible at this point to know what the outcome will be, it is certainly worth running through the possibilities.  </p>
<p class="textBodyBlack"><span /></p>
<p class="textBodyBlack"><span />First, let’s do a primer on the deduction as it stands now:</p>
<p class="textBodyBlack"><span />The deduction lets homeowners reduce their taxable income by the amount of interest paid on their mortgage. This can be on the principal residence or a second home, but not on mulitple investment properties. Taxpayers are eligible for this deduction only if they itemize. Finally, the interest deduction is capped at $1 million of your mortgage.</p>
<p class="textBodyBlack"><span />This deduction, which is the largest housing-related subsidy in the U.S. tax code, reduced income-tax revenue by $79.9 billion in fiscal year 2007, according to the Office of Management and Budget. <p></p>
<p class="textBodyBlack"><span />So what is that in real cash savings to taxpayers? Number crunchers at the Wharton business school did the math:</p>
<p class="textBodyBlack"><span />For those making less than $40,000 a year, the average tax savings is about $100. But in that bracket less than one-quarter of homeowners itemize deductionsl, so most don’t get anything.  </p>
<p class="textBodyBlack"><span />For those earning up to $250,000, the average savings, based on average mortgage amounts, would be $1,200-$2,600 a year. For those earning more than $250,000, and 100 percent of them itemize, the average savings is $5,400 a year.</p>
<p class="textBodyBlack"><span />Now to the proposals—and they are many.</p>
<p class="textBodyBlack"><span />One, released by the Simpson-Bowles commission, would cap the mortgage interest deduction at $500,000 of the home’s value and limit the deduction to primary residences. <p class="textBodyBlack"><span />A bipartisan plan from Domenici-Rivlin would limit the deduction to just $25,000 worth of mortgage interest.</p>
<p class="textBodyBlack"><span />Other proposals include eliminating the deduction only for taxpayers earning $250,000 or more, ending the benefit for second homes, ending the deduction entirely or limiting the amount of all itemized deductions to $25,000. That last one was advocated by Mitt Romney, but apparently some Democrats on Capitol Hill are starting to espouse it. <p class="textBodyBlack"><span />Without one proposal leading the pack, again, it is impossible to boil down the real cost to homeowners, but suffice it to say that anyone in the business of home ownership is opposed to reducing the mortgage interest deduction.</p>
<p class="textBodyBlack"><span /></p>
<p class="textBodyBlack"><span />“It’s chilling the market,” said Jerry Howard, CEO of the National Association of Home Builders.  “Whenever there is uncertainty surrounding the value of an American home, why would you expect people to go out and buy a home? Or, just as much to the point, when there’s uncertainty about the value of a home why would someone put their house on the market to sell it, that’s why this whole debate to me is counter-productive and is only retarding the nation’s economic recovery.”</p>
<p class="textBodyBlack"><span />“The mortgage interest deduction is vital to the stability of the American housing market and economy, and we will remain vigilant in opposing any future plan that modifies or excludes the deductibility of mortgage interest,&#8221; said Gary Thomas, president of the National Association of Realtors. <p class="textBodyBlack"><span />Whatever the arguments for or against the mortgage interest deduction, two things are indisputable.  Going over the fiscal cliff will kill the housing recovery, but said recovery is already so tenuous that yet another barrier to entry will hurt.</p>

<p>It&#8217;s not like the housing market needs any more headwinds, so here&#8217;s the government potentially giving us another: The mortgage interest deduction is back in big play in the budget deal. </p>
<p>It never exactly came off the table, but the bigger the budget deal, the more likely the mortgage deduction will take a bigger hit. </p>
<p>Right now, home loan borrowers can deduct the amount of interest they pay on their mortgages from their taxable income. This goes for principal residences and second homes. The interest deduction is capped at the first million dollars of debt on the home. For home equity loans it&#8217;s capped at $100,000 in debt. </p>
<p><strong>The deduction costs the U.S. Treasury about $100 billion a year.</strong> There are proposals now to either reduce the cap to $500,000 and/or to eliminate the deduction on second homes. Eliminating the deduction on second homes would save about $15 billion, and reducing the cap to $500,000 would save another $15 billion, according to economist William Wheaton at MIT. 10.5 percent of existing home sales in June were of homes over $500,000 according to the Mortgage Bankers Association. </p>
<p>Then there&#8217;s the idea from the President&#8217; bipartisan commission of turning the interest deduction into a 12 percent credit, limited to $500,000 in mortgage debt, only on primary residences. That could save the Treasury $65 billion. </p>
